Unfortunately, separations and divorces are not always peaceful. Sometimes, one spouse will try and take the child out of state to deprive the other spouse of seeing that child, so prior to filing a petition for divorce, both parents generally have a legal right to take their children and to travel with those children. If you suspect that your spouse is planning on taking your children out of state, it is very important that you file for divorce in order to get the legal protection you need to keep your spouse from doing that. Once a petition for divorce has been filed, the courts will intervene and prohibit one spouse from taking the children out of state without the court’s permission or the other spouse’s permission.
