If someone is in a dangerous situation, first of all, think a little bit less about the divorce proceeding and think about your own safety and what you need to take care of. If the police need to be contacted, don’t fear calling the police. And if you need to leave the home for your own safety, don’t worry about the ramifications of that in a divorce. Worry about your own self first. The worst thing that people tend to do is think about the bottom line and not think about what they really need to do for themselves. They are worried about how it’s going to look to a judge, or what if I do this. But what I tell clients is you need to take care of yourself during this process, it’s a demanding, stressful time. If you don’t take care of yourself, you’re going to end up in not a good place quite frankly.

In cases where somebody has no access to their marital funds, one thing they can do is to certainly ask for a loan from family members and we would certainly ask for a reward of attorney’s fees in that case. So, it’s likely in the future they are going to end up having those marital funds. If they don’t have access to it at all, we can work with people on a lower retainer perhaps up front, because we know there is going to be a reward of attorney’s fees later on down the road.
